[Foreign Individuals Must Pay 20% Personal Income Tax on Dividends from Foreign-Invested Enterprises]
The Ministry of Finance and the State Taxation Administration announced today that dividends and profits obtained by foreign individuals from foreign-invested enterprises shall be subject to personal income tax under the category of 'interest, dividends, and profit income' at a rate of 20%. Foreign-invested enterprises must withhold and remit the tax when paying dividends to foreign individuals and file the tax declaration by the 15th of the following month. If the tax is not withheld, the foreign individual receiving the income must pay it themselves by June 30 of the following year. If notified by the tax authorities within a specified period, the payment must be made within the deadline. The announcement will take effect on September 1, 2026, and the relevant old regulations from 1994 will be simultaneously repealed.
