The U.S. Attorney for the Southern District of New York has requested the court to dismiss former Celsius CEO Alex Mashinsky's motion to overturn his conviction and 12-year sentence, stating that several of his claims 'lack merit' and refuting his argument that his defense attorney failed to provide effective legal assistance. Mashinsky was sentenced to 144 months in prison in May 2025 for commodities fraud and securities fraud related to Celsius. He later chose to represent himself and filed to overturn the conviction and sentence. As of now, the judge presiding over the case has yet to respond to the prosecution's objections.
