The bill would also ban prediction platforms from contracting with or sharing revenue with companies typically engaged in gambling activities. The restrictions extend to parent companies, subsidiaries, affiliates, joint ventures, employees, and entities acting for the financial benefit of other companies. DraftKings and Flutter have previously advanced market-making operations, with DraftKings recently launching the DKeX exchange following its acquisition of CFTC-registered company Railbird Technologies. HB 2711 proposes setting a minimum participation age of 21 and requires platforms to exclude self-excluded users, company employees, settlement source employees, and individuals with insider information. The bill also mandates platforms to implement commercially reasonable measures to prevent fraud, manipulation, and misuse of material non-public information. Additionally, it prohibits markets related to high school sports, minors participating in sports events, personal health conditions, and death events. The proposal does not establish a licensing system, with enforcement authority delegated to the state Attorney General. Pennsylvania also has a companion bill, HB 2497, which proposes requiring platforms to obtain licensing from the Pennsylvania Gaming Control Board and imposing a combined 22% tax on prediction platform revenue.
