The custody rules were originally intended to cover all client assets, including cryptocurrencies, expanding the scope of the definition of "custody" and sparking controversy over whether certain state chartered agencies should be considered qualified custodians. Rule 3b-16 proposes to include decentralized finance (DeFi) exchanges/platforms within the regulatory scope of national securities exchanges.
