The United States Court of Appeals for the Federal Circuit has granted the Trump administration's request to temporarily suspend the International Trade Court's ruling prohibiting the enforcement of multiple US government tariff executive orders. As we talked yesterday, under the framework of the Trade Expansion Act of 1962 and the International Emergency Economic Power Act at the end of 1977, Trump still has considerable room for game. 1. The Federal Circuit Court of Appeals did not disclose how long its order will last, but has set a briefing schedule until June 9th, requiring both the Trump administration and the International Trade Court to provide written defense documents on the issue of blocking tariffs by early June. 2. The suspension order temporarily suspends the ruling that prevented the Trump administration from implementing global tariffs, and is considering a longer suspension of its enforcement. 3. A court document submitted by the US Department of Justice to the appellate court states that if the federal appellate court does not suspend the ruling that most of the government's tariff enforcement is illegal, the government will submit the case to the US Supreme Court as early as this Friday.
